Terms & Conditions:
If you have any questions about these Terms & Conditions or if you do not wish to accept them, please contact me at [email protected]. You may have other rights granted by law, and these Terms & Conditions do not affect these except if the two are inconsistent. If this is the case, then these Terms & Conditions will override any other rights that you may have, unless law does not permit this. 'Work product' and 'project' refer to any written or spoken texts or linguistic data produced, proofread, edited, processed or collected by me upon your request.
1. Prices and VAT:
All prices listed or quoted are exclusive of value added tax in accordance with 6 [1] Z 27 UStG (Austrian law) and you will not be charged VAT. Prices are displayed and charged in US dollars (USD). Where applicable, reverse charge applies.
2. Delivery Terms:
I am happy to send work products electronically (via email or the internet) or by post (registered post or courier service) to the delivery address you request, but I cannot give exact delivery dates and times. Postal charges apply only on orders despatched by post or courier service. Orders lost in the post will be sent a second time free of charge but no money refund will be made.
3. Payments:
You can pay using your credit card or PayPal or make a mobile payment using ApplePay or AndroidPay. This shop uses Stripe as a payment services provider. All credit card and mobile wallet payments are processed through the Stripe payment module integrated into the shop and linked to the website hosting services provider Weebly.
4. Guarantees & Indemnity:
I promise to correct free of charge any faults or defects in the work products I have sent you and for which I am responsible, if your request for correction is made in writing without delay after your becoming aware of them and not later than 24 months after receipt of the finished work product. You agree not to demand any other form of compensation from me or to hold me liable for any losses you incur as a consequence of using my services, unless these are proven to be the result of intent or gross negligence on my part.
5. Cancellation Right:
You have the right to cancel an order at any time before I have started work on your project. Once I have started work on your project and you have agreed to my doing so, you have the right to cancel the contract without stating a reason within 14 days of placing the order. You agree to inform me of the cancellation in writing and to pay me for hours already worked on your project(s).
6. Additional Services:
You may state any additional requests in writing at any time during the work in progress. I reserve the right to decline or propose the use of tools and electronic devices.
7. Ownership of Work Product and Intellectual Property Right:
You agree to grant to me all rights to the work products I have produced until full payment has been made.
8. Confidentiality:
I agree to keep in confidence and to refrain from intentionally disclosing to any third party in writing or by word of mouth the contents and purpose of the material and communications sent to me, except where this is requested by you or where it is necessary and I have sought your permission. Your materials will not be entered into software as a service (SaaS).
9. Privacy:
The personal information (name, billing and shipping address, email address and phone number) you provide will be used for the sole purpose of fulfilling the work contract arising from your order and will not be used for any other purpose or shared with third parties. Your payment details will be collected by the credit card processor Stripe. This website also uses cookies, and you will be requested to accept their use.
10. Governing Law:
All transactions are governed by Austrian law. The court for jurisdiction and disputes settlement is in 3100 Sankt Pölten, Austria. In compliance with the European Union legislation for the protection of consumer rights, I inform you that procedures for Alternative Dispute Resolution (ADR) or out-of-court dispute settlements will be handled by the following body: Internet Ombudsmann, http://www.ombudsmann.at/
